Justice & Law โ The Connection
โฌ๏ธ The Supreme Court of India, New Delhi โ highest court of the land
Justice = ensuring individuals can live with equality and dignity. The Preamble to India's Constitution promises all citizens social, economic, and political justice. Laws are general rules made by government to regulate activities and impose consequences for violations.
Focuses on the outcome/result. Was the final decision actually fair, just & reasonable?
Every person gets a full opportunity to be heard before a decision is taken. Presumed innocent until proven guilty.
India repealed 1500+ discriminatory colonial laws after independence. Examples: Criminal Tribes Act 1871 (labelled communities as criminals by birth!), Vernacular Press Act 1878 (censored Indian press). Similarly, US repealed Jim Crow laws (1960s) & South Africa ended apartheid (1991).

Judiciary is independent from Legislature & Executive โ the third pillar of government. This independence ensures disputes are decided fairly, without political pressure. Judiciary also checks that laws passed by Parliament are constitutional!
The Supreme Court
- Established: 26 January 1950 (when Constitution came into effect)
- Located: New Delhi
- Strength: Chief Justice of India + 33 Judges
- Appointed by: President of India (Article 124)
- Retirement age: 65 years
- Motto: "Yato Dharmastato Jayah" โ "Where there is dharma, there is victory"
- Final interpreter of the Constitution
Disputes between Centre & States, or between two states (e.g., river water disputes)
Hears appeals from High Court judgments in constitutional/criminal/civil matters
President can seek SC's opinion on important legal/constitutional questions
High Courts & District Courts
- One per State/UT (some states share)
- Chief Justice + other judges

- Supervise all lower courts in the state
- Calcutta HC (1862) โ oldest in India
- Most common courts for citizens

PIL & Writ Petitions
PIL = ANY citizen can file a case in the Supreme Court or High Court on behalf of the PUBLIC interest โ not just for personal grievances! First PIL was by lawyer Mrs Kapila Hingorani โ secured release of 40,000 under-trial prisoners in Bihar!
- M.C. Mehta vs Union of India โ cleaning Ganga river, protecting Taj Mahal from pollution
- Vishaka vs State of Rajasthan (1997) โ SC laid down guidelines against sexual harassment at workplace โ led to Sexual Harassment Act 2013
- Direct approach to SC (Article 32) or HC (Article 226) for Fundamental Rights violations
- 5 types of writs: Habeas Corpus, Mandamus, Prohibition, Certiorari, Quo Warranto
- Habeas Corpus = "Produce the body" โ used to free illegally detained persons
Alternative Dispute Resolution (ADR)
Courts are overburdened with millions of pending cases. ADR provides faster, cheaper, and less adversarial ways to resolve disputes. Parties reach agreement through mutual discussion rather than court battles.
Neutral third party (mediator) helps parties reach a voluntary agreement. Not binding โ parties decide.
Neutral arbitrator hears both sides and gives a binding decision. Like a private judge. Used in commercial disputes.
Conciliator actively suggests solutions to help parties settle. More active role than mediator.
Lok Adalat & Nyaya Panchayat
- Set up under Legal Services Authority Act 1987
- Award has legal validity โ same as court decree
- No court fees; FREE for citizens
- Cases: motor accident claims, matrimonial, labour disputes
- Millions of cases settled quickly!
- Village-level justice system
- Resolves minor disputes at grassroots level
- Traditional wisdom + legal framework
- Accessible to rural communities without travelling to courts
