Describe the types of Insurance.बीमा के प्रकारों का वर्णन कीजिए ।

Meaning

Insurance is a contract in which the insurer, in return for a premium, promises to compensate the insured for a specified loss or to pay a fixed sum on the happening of a specified event. It works on the principle of pooling and sharing of risk.

Main types

### 1. Life insurance
The insurer pays the sum assured on the death of the insured or on maturity of the policy. It is a contract of assurance, since the event is certain. Main plans:

  • Whole life policy — cover for the whole life; amount paid to the nominee on death.
  • Endowment policy — paid on maturity or earlier death; combines protection with saving.
  • Term insurance — pure risk cover, low premium, no maturity value.
  • Money-back and annuity/pension plans, ULIPs, and child and joint-life plans.

Regulated by the IRDAI; LIC and private companies operate in this field.

### 2. General (non-life) insurance
A contract of indemnity for one year or less, renewed each year.

  • Fire insurance — loss of building, stock and machinery by fire, lightning, explosion and allied perils.
  • Marine insurance — hull, cargo, freight and liability; the oldest form of insurance.
  • Motor insurance — third-party cover (compulsory under the Motor Vehicles Act) and comprehensive cover.
  • Health/mediclaim insurance — hospital and treatment expenses, family floater, Ayushman Bharat.
  • Personal accident insurance — death or disability by accident.
  • Property, burglary and householder's insurance.
  • Crop and cattle insurance — PMFBY for crops.
  • Liability insurance — public liability, product liability, professional indemnity.
  • Fidelity guarantee, credit and engineering insurance.

### 3. On the basis of scope
Social insurance (ESI, EPF, government-sponsored schemes such as PMJJBY, PMSBY and Atal Pension Yojana) and commercial insurance taken voluntarily.

Conclusion

Life insurance protects the earning capacity of a person while general insurance protects property and liability. Together they give financial security to individuals and to business.

बीमा वह अनुबंध है जिसमें बीमाकर्ता, प्रीमियम के बदले, बीमित को निर्दिष्ट हानि की क्षतिपूर्ति करने अथवा निर्दिष्ट घटना घटित होने पर निश्चित राशि देने का वचन देता है। यह जोखिम के संग्रहण एवं विभाजन के सिद्धांत पर कार्य करता है।

प्रमुख प्रकार

### 1. जीवन बीमा
बीमाकर्ता बीमित की मृत्यु पर अथवा पॉलिसी की परिपक्वता पर बीमित राशि का भुगतान करता है। यह आश्वासन का अनुबंध है, क्योंकि घटना निश्चित है। प्रमुख योजनाएँ :

  • संपूर्ण जीवन पॉलिसी — आजीवन सुरक्षा; मृत्यु पर नामिती को भुगतान।
  • बंदोबस्ती (एंडोमेंट) पॉलिसी — परिपक्वता पर अथवा उससे पूर्व मृत्यु पर भुगतान; सुरक्षा व बचत का संयोग।
  • सावधि (टर्म) बीमा — शुद्ध जोखिम सुरक्षा, कम प्रीमियम, परिपक्वता मूल्य नहीं।
  • मनी-बैक तथा वार्षिकी/पेंशन योजनाएँ, यूलिप, बाल व संयुक्त जीवन योजनाएँ।

इसका नियमन IRDAI करता है; इस क्षेत्र में एलआईसी तथा निजी कंपनियाँ कार्यरत हैं।

### 2. सामान्य (गैर-जीवन) बीमा
एक वर्ष या उससे कम का क्षतिपूर्ति अनुबंध, जिसका प्रतिवर्ष नवीनीकरण होता है।

  • अग्नि बीमा — अग्नि, वज्रपात, विस्फोट व संबद्ध जोखिमों से भवन, स्टॉक व मशीनरी की हानि।
  • समुद्री बीमा — पोत, माल, भाड़ा व दायित्व; बीमा का प्राचीनतम रूप।
  • मोटर बीमा — तृतीय पक्ष बीमा (मोटर यान अधिनियम के अंतर्गत अनिवार्य) तथा व्यापक बीमा।
  • स्वास्थ्य/मेडिक्लेम बीमा — अस्पताल व उपचार व्यय, फैमिली फ्लोटर, आयुष्मान भारत।
  • व्यक्तिगत दुर्घटना बीमा — दुर्घटना से मृत्यु अथवा अपंगता।
  • संपत्ति, सेंधमारी व गृहस्वामी बीमा।
  • फसल व पशु बीमा — फसलों हेतु पीएमएफबीवाई।
  • दायित्व बीमा — सार्वजनिक दायित्व, उत्पाद दायित्व, व्यावसायिक क्षतिपूर्ति।
  • निष्ठा गारंटी, साख तथा इंजीनियरिंग बीमा।

### 3. क्षेत्र के आधार पर
सामाजिक बीमा (ईएसआई, ईपीएफ, पीएमजेजेबीवाई, पीएमएसबीवाई व अटल पेंशन योजना जैसी सरकारी योजनाएँ) तथा स्वेच्छा से लिया जाने वाला व्यावसायिक बीमा

निष्कर्ष

जीवन बीमा व्यक्ति की अर्जन क्षमता की रक्षा करता है, जबकि सामान्य बीमा संपत्ति व दायित्व की। दोनों मिलकर व्यक्तियों तथा व्यवसाय को वित्तीय सुरक्षा प्रदान करते हैं।

Explain the main principles of Insurance.बीमा के प्रमुख सिद्धान्तों को समझाइए ।

Insurance contracts rest on certain legal and business principles which make the contract fair and workable.

1. Utmost good faith (Uberrimae fidei)

Both parties must disclose all material facts truthfully and completely. The proposer must reveal age, health, habits, previous illness, occupation and past claims; the insurer must explain the terms. Concealment or misrepresentation makes the policy voidable.

2. Insurable interest

The insured must gain from the existence of the subject matter and suffer loss from its destruction. A person has insurable interest in his own life, in his spouse, in his property and in the goods of his business. In life insurance it must exist at the time of taking the policy; in fire insurance both at the time of the contract and at the time of loss; in marine insurance at the time of loss.

3. Indemnity

The insured is placed in the same financial position as before the loss — no profit, no loss. He cannot recover more than the actual loss or the sum insured, whichever is less. It applies to general insurance but not to life and personal accident insurance, because human life cannot be valued.

4. Subrogation

After paying the claim, the insurer steps into the shoes of the insured and acquires all his rights and remedies against the third party responsible for the loss. It prevents the insured from being paid twice.

5. Contribution

When the same subject matter is insured with more than one insurer, each insurer pays the loss in proportion to the sum insured by it. The insured cannot recover the full amount from each.

6. Proximate cause (Causa proxima)

The nearest and most effective cause of the loss is considered, not a remote cause. The claim is paid only if the proximate cause is an insured peril.

7. Mitigation of loss

On the happening of the event the insured must act like a prudent uninsured person and take all reasonable steps to minimise the loss.

Conclusion

These principles protect both parties: they prevent fraud, gambling and over-insurance and ensure that insurance remains a device for compensating genuine loss.

बीमा अनुबंध कुछ विधिक एवं व्यावसायिक सिद्धांतों पर आधारित होते हैं, जो अनुबंध को न्यायसंगत व व्यवहार्य बनाते हैं।

1. परम सद्भावना (Uberrimae fidei)

दोनों पक्षों को समस्त तात्त्विक तथ्य सत्यतापूर्वक व पूर्ण रूप से प्रकट करने चाहिए। प्रस्तावक को आयु, स्वास्थ्य, आदतें, पूर्व बीमारी, व्यवसाय व पूर्व दावे बताने चाहिए; बीमाकर्ता को शर्तें स्पष्ट करनी चाहिए। छिपाव अथवा मिथ्या कथन से पॉलिसी शून्यकरणीय हो जाती है।

2. बीमा योग्य हित

बीमित को विषय-वस्तु के अस्तित्व से लाभ तथा उसके नष्ट होने से हानि होनी चाहिए। व्यक्ति का अपने जीवन, पति/पत्नी, अपनी संपत्ति तथा व्यवसाय के माल में बीमा योग्य हित होता है। जीवन बीमा में यह पॉलिसी लेते समय, अग्नि बीमा में अनुबंध व हानि दोनों समय, तथा समुद्री बीमा में हानि के समय होना चाहिए।

3. क्षतिपूर्ति

बीमित को हानि से पूर्व वाली वित्तीय स्थिति में रखा जाता है — न लाभ, न हानि। वह वास्तविक हानि अथवा बीमित राशि, जो कम हो, उससे अधिक प्राप्त नहीं कर सकता। यह सामान्य बीमा पर लागू होता है, किंतु जीवन तथा व्यक्तिगत दुर्घटना बीमा पर नहीं, क्योंकि मानव जीवन का मूल्यांकन संभव नहीं।

4. प्रतिस्थापन (सब्रोगेशन)

दावा चुकाने के बाद बीमाकर्ता बीमित के स्थान पर आ जाता है और हानि हेतु उत्तरदायी तृतीय पक्ष के विरुद्ध उसके समस्त अधिकार प्राप्त कर लेता है। इससे बीमित को दोहरा भुगतान नहीं मिलता।

5. अंशदान

जब एक ही विषय-वस्तु का बीमा एक से अधिक बीमाकर्ताओं से हो, तो प्रत्येक बीमाकर्ता अपनी बीमित राशि के अनुपात में हानि चुकाता है। बीमित प्रत्येक से पूरी राशि नहीं ले सकता।

6. निकटतम कारण (Causa proxima)

हानि का निकटतम एवं सर्वाधिक प्रभावी कारण देखा जाता है, दूरस्थ कारण नहीं। दावा तभी चुकाया जाता है जब निकटतम कारण बीमाकृत जोखिम हो।

7. हानि न्यूनीकरण

घटना घटित होने पर बीमित को विवेकशील अबीमित व्यक्ति की भाँति आचरण करते हुए हानि कम करने के समस्त उचित प्रयास करने चाहिए।

निष्कर्ष

ये सिद्धांत दोनों पक्षों की रक्षा करते हैं : ये छल, सट्टेबाजी व अति-बीमा को रोकते हैं और सुनिश्चित करते हैं कि बीमा वास्तविक हानि की क्षतिपूर्ति का साधन बना रहे।

Explain the steps of Settlement of Insurance Claim.बीमा दावों के निराकरण के चरणों को समझाइए ।

ANSWERउत्तर

Meaning

A claim is the demand made by the insured (or the nominee) on the insurer to pay the amount promised, after the insured event has happened. Settlement is the process by which the insurer verifies and pays that demand.

Steps in settlement

  1. Intimation of loss: the insured informs the insurer immediately, in writing or online, giving the policy number, date, place and nature of the loss. Delay may weaken the claim.
  2. Registration of the claim: the insurer records the claim, allots a claim number and checks whether the policy is in force and the premium is paid.
  3. Submission of claim form and documents:
  • Life insurance (death claim): death certificate, original policy, claim forms, proof of age, identity and nominee's KYC, and in unnatural death the FIR and post-mortem report.
  • Health claim: hospital bills, discharge summary, prescriptions, investigation reports; or a cashless pre-authorisation through the TPA.
  • Motor/fire/marine claim: FIR or police report, driving licence and RC, repair estimate, photographs, invoices and stock records.
  1. Investigation and survey: in general insurance an IRDAI-licensed surveyor and loss assessor inspects the loss (compulsory above the prescribed limit) and submits a survey report assessing the actual loss.
  2. Verification and scrutiny: the insurer examines whether the peril is covered, whether the proximate cause is an insured peril, whether there is any exclusion, misrepresentation or breach of condition, and checks insurable interest and the sum insured.
  3. Assessment of the amount payable: applying indemnity, average clause (in case of under-insurance), depreciation, excess/deductible, contribution and subrogation.
  4. Approval and settlement: the claim is approved and paid directly to the bank account of the insured or nominee; in cashless health claims the payment goes to the hospital. IRDAI norms require settlement generally within 30 days of receipt of the last document (and within a short period after the surveyor's report in general insurance); interest is payable on delay.
  5. Repudiation, if any: if the claim is not payable, the insurer must inform the claimant in writing with reasons.
  6. Grievance redressal: the claimant may approach the insurer's grievance cell, the Insurance Ombudsman, the IRDAI's Bima Bharosa portal or the consumer court.

Conclusion

Prompt and fair claim settlement is the real test of an insurance company; it decides the trust of the public and the reputation of the insurer.

दावा वह माँग है जो बीमित (अथवा नामिती) बीमाकृत घटना घटित होने के बाद वचनित राशि हेतु बीमाकर्ता से करता है। निराकरण वह प्रक्रिया है जिससे बीमाकर्ता उस माँग की जाँच कर भुगतान करता है।

निराकरण के चरण

  • जीवन बीमा (मृत्यु दावा) : मृत्यु प्रमाणपत्र, मूल पॉलिसी, दावा प्रपत्र, आयु प्रमाण, पहचान व नामिती की केवाईसी, तथा अस्वाभाविक मृत्यु में एफआईआर व पोस्टमार्टम रिपोर्ट।
  • स्वास्थ्य दावा : अस्पताल बिल, डिस्चार्ज सारांश, पर्चियाँ, जाँच रिपोर्ट; अथवा टीपीए द्वारा कैशलेस पूर्व-अनुमोदन।
  • मोटर/अग्नि/समुद्री दावा : एफआईआर या पुलिस रिपोर्ट, ड्राइविंग लाइसेंस व आरसी, मरम्मत अनुमान, चित्र, बीजक तथा स्टॉक अभिलेख।
  1. जाँच एवं सर्वे : सामान्य बीमा में आईआरडीएआई से लाइसेंस प्राप्त सर्वेयर व हानि निर्धारक हानि का निरीक्षण करता है (निर्धारित सीमा से ऊपर अनिवार्य) और वास्तविक हानि का आकलन करती सर्वे रिपोर्ट देता है।
  2. सत्यापन एवं संवीक्षा : बीमाकर्ता देखता है कि जोखिम कवर है या नहीं, निकटतम कारण बीमाकृत जोखिम है या नहीं, कोई अपवर्जन, मिथ्या कथन या शर्त भंग तो नहीं, तथा बीमा योग्य हित व बीमित राशि की जाँच करता है।
  3. देय राशि का निर्धारण : क्षतिपूर्ति, औसत खंड (अल्प-बीमा की स्थिति में), मूल्यह्रास, कटौती योग्य राशि, अंशदान तथा प्रतिस्थापन लागू करते हुए।
  4. स्वीकृति एवं भुगतान : दावा स्वीकृत कर बीमित या नामिती के बैंक खाते में सीधे भुगतान किया जाता है; कैशलेस स्वास्थ्य दावों में भुगतान अस्पताल को जाता है। आईआरडीएआई मानकों के अनुसार अंतिम दस्तावेज मिलने से सामान्यतः 30 दिन में निराकरण अपेक्षित है (सामान्य बीमा में सर्वेयर रिपोर्ट के बाद अल्प अवधि में); विलंब पर ब्याज देय होता है।
  5. अस्वीकृति (यदि हो) : दावा देय न होने पर बीमाकर्ता को कारण सहित लिखित सूचना देनी होती है।
  6. शिकायत निवारण : दावेदार बीमाकर्ता के शिकायत प्रकोष्ठ, बीमा लोकपाल, आईआरडीएआई के बीमा भरोसा पोर्टल अथवा उपभोक्ता न्यायालय में जा सकता है।

शीघ्र एवं न्यायसंगत दावा निराकरण ही बीमा कंपनी की वास्तविक कसौटी है; इसी से जनता का विश्वास तथा बीमाकर्ता की प्रतिष्ठा तय होती है।

Explain role of the Securities and Exchange Board of India (SEBI).भारतीय प्रतिभूति और विनिमय बोर्ड (सेबी) की भूमिका की व्याख्या कीजिए ।

SEBI was set up in 1988 as a non-statutory body and was given statutory status by the SEBI Act, 1992. Its head office is in Mumbai. It was created after scandals and malpractices in the securities market to protect investors and to regulate the capital market.

Objectives

  • Protection of the interest of investors.
  • Development of the securities market.
  • Regulation of the securities market and its intermediaries.

Functions and role

### 1. Protective functions

  • Prohibits insider trading, price rigging, and fraudulent and unfair trade practices.
  • Bans misleading advertisements and misstatements in prospectus.
  • Requires full and fair disclosure by companies.
  • Runs investor education and awareness programmes and the SCORES grievance redressal system.

### 2. Regulatory functions

  • Registers and regulates stock exchanges, brokers, sub-brokers, merchant bankers, registrars, underwriters, portfolio managers, mutual funds and depositories.
  • Frames rules and a code of conduct for intermediaries, and conducts inspection and audit.
  • Regulates takeovers and mergers through the Takeover Code.
  • Can impose penalty, suspend or cancel registration, and pass orders debarring persons from the market.
  • Regulates credit rating agencies, investment advisers and research analysts.

### 3. Developmental functions

  • Promotes training of intermediaries and investor education.
  • Encourages dematerialisation, electronic trading, online IPO and faster settlement (T+1).
  • Permits internet-based trading, discount broking and new instruments such as REITs, InvITs and index derivatives.
  • Simplifies IPO procedures and introduced ASBA and UPI-based application.

Powers of SEBI

Quasi-legislative (making regulations), quasi-executive (investigation, inspection, search and seizure) and quasi-judicial (passing orders and imposing penalties). Appeals against SEBI orders lie with the Securities Appellate Tribunal (SAT).

SEBI has changed the Indian capital market from an unregulated, scandal-prone market into a transparent, technology-driven and investor-friendly one, which has raised the confidence of both domestic and foreign investors.

अर्ध-विधायी (विनियम बनाना), अर्ध-कार्यपालिक (जाँच, निरीक्षण, तलाशी व जब्ती) तथा अर्ध-न्यायिक (आदेश देना व शास्ति लगाना)। सेबी के आदेशों के विरुद्ध अपील प्रतिभूति अपीलीय अधिकरण (SAT) में होती है।
